Cancer is an evolutionary and ecological process in which complex interactions between tumour cells and their environment share many similarities with organismal evolution. Tumour cells with highest adaptive potential have a selective advantage over less fit cells. Naturally occurring transmissible cancers provide an ideal model system for investigating the evolutionary arms race between cancer cells and their surrounding micro‐environment and macro‐environment. However, the evolutionary landscapes in which contagious cancers reside have not been subjected to comprehensive investigation. Here, we provide a (...) multifocal analysis of transmissible tumour progression and discuss the selection forces that shape it. We demonstrate that transmissible cancers adapt to both their micro‐environment and macro‐environment, and evolutionary theories applied to organisms are also relevant to these unique diseases. The three naturally occurring transmissible cancers, canine transmissible venereal tumour (CTVT) and Tasmanian devil facial tumour disease (DFTD) and the recently discovered clam leukaemia, exhibit different evolutionary phases: (i) CTVT, the oldest naturally occurring cell line is remarkably stable; (ii) DFTD exhibits the signs of stepwise cancer evolution; and (iii) clam leukaemia shows genetic instability. While all three contagious cancers carry the signature of ongoing and fairly recent adaptations to selective forces, CTVT appears to have reached an evolutionary stalemate with its host, while DFTD and the clam leukaemia appear to be still at a more dynamic phase of their evolution. Parallel investigation of contagious cancer genomes and transcriptomes and of their micro‐environment and macro‐environment could shed light on the selective forces shaping tumour development at different time points: during the progressive phase and at the endpoint. A greater understanding of transmissible cancers from an evolutionary ecology perspective will provide novel avenues for the prevention and treatment of both contagious and non‐communicable cancers. Few Star Wars characters are more beloved than Luke Skywalker, Jedi Knight, son of Darth Vader, and mentor to Rey. Fictional characters like Luke are wholly defined by how people understand, interpret, and evaluate their depictions within the fictions in which they appear. This chapter explores various ways to provide identity conditions for fictional characters. It examines a more sophisticated, but again ultimately incorrect, account of fictional character identity: the Say‐So Account, in which authors determine whether two characters, from two (...) fictional works, are identical. The Perspectival Account avoids the problems seen in the earlier accounts and provides the authors with an adequate account of identity conditions for fictional characters. Anagrams and syllabic wordplay of the kind championed by Frederick Ahl in his Metaformations have not always been favourably received by scholars of Latin poetry; I would hesitate to propose the following instance, were it not for the fact that its occurrence seems peculiarly apposite to the context in which it appears. That Roman poets were prepared to use such techniques to enhance the presentation of an argument by exemplifying its operation at a verbal level is demonstrated by the famous (...) passage of Lucretius in which the poet seeks to illustrate the tendency of semina … ardoris to create fire in wood by the literal presence of elements from the word for ‘fires’ in that denoting wood. A similar conception may underlie the association insinuated by the love elegists between amor and mors, suggesting that death is somehow ‘written into’ love: so Propertius declares laus in amore mori, while Tibullus appears to point to the lurking presence of death in the pursuit of love in the lines interea, dum fata sinunt, iungamus amores: | iam ueniet tenebris Mors adoperta caput – so swift and unexpected is death's approach that it is already present in aMOReS in the preceding line. Ovid's awareness of the poetic potential of this kind of play is fully exhibited in his celebrated account of Echo and Narcissus in Metamorphoses 3, where the subject matter gives the poet ample scope to exploit the humorous and pathetic possibilities afforded by Echo's fragmented repetitions of the frustrated entreaties of her beloved. As it happened, I became acquainted with E.V. Il'enkov quite late, in the mid- or even the late 1960s. It was only a bit more than ten years before his death that I began to feel at home in his house, was able to visit without calling ahead, and was able to call him by his first name and the familiar "you"—that is, like many, many of not only his true friends but also like-minded thinkers, who became his close acquaintances, (...) most of whom justly considered themselves his pupils … The door would open wide, and Olia, Professor K.I. Salimova, Eval'd's wife and most devoted friend, not at all surprised by the unexpected guest and seemingly even quite happy at his arrival , would try first to draw him into the kitchen and feed him … which she more often than not succeeded in doing. I am not talking about myself: there were always many guests, and this is precisely how they arrived at the Il'enkovs' apartment. Recently, a critic in Literaturnaia gazeta recalled those whom he met in Eval'd's apartment in the 1960s: "This was a tight circle of like-minded thinkers," wrote the critic. "But some of them are no longer with us, while most are far away, beyond our borders." Obviously, he had not been in the house often or had forgotten things over the distance of years. There was no "circle," nor could there have been one—not with this host, not with his lifestyle and way of relating to people. I met a good hundred fine and various people in Eval'd's home: I.N. Korzhavin, V. Davydov, A. Meshcheriakov, S. Vinogradova, N. Dubinin, V. Zinchenko, A. Zinov'ev, Iu. Kamiakin, and … indeed, five pages would not be enough to list the quite famous and the not-quite-so-famous, simply ordinary people with no claim to fame. Nazym Khikmet, A.N. Leont'ev, and B.M. Kedrov were friends of the house … Ever new faces, figures, and words come to mind. I cannot forgive myself: once Eval'd Vasil'evich wanted to take me along to Iurii Liubimov's to read his play Neither God nor Tsar nor Hero … [Ni bog, ni tsar' i ni geroi], but I had some other business, something so important that I do not even remember now what it was, and it is probably not worth remembering. But most likely I was too timid to appear uninvited at the house of a person burning with creativity. The same thing happened with Galich … Eval'd liked especially his song about Zoshchenko. He did not sing it; he narrated it, but in such a way that tears always came to one's eyes. (shrink)

Hauptman’s paper tells of a Mr. A, who refused exogenous treatment for the depression he felt consequent on the end of a romantic relationship, because such treatment seems to be inauthentic and despicable. It seemed this way because the depression felt like an apt response to the loss of the beloved.Like Hauptman, I have some sympathy with Mr. A’s position. To medicate away authentic emotional reactions to the trials of living is, it seems to me, to promote a form of (...) self-alienation and radical inauthenticity. Philosophers have long been interested in love and its general role in morality. This volume focuses on and explores the complex relation between love and justice as it appears within loving relationships, between lovers and their wider social context, and the broader political realm. Special attention is paid to the ensuing challenge of understanding and respecting the lovers’ personal autonomy in all three contexts. Accordingly, the essays in this volume are divided into three thematic sections. Section I aims at shedding (...) further light on conceptual and practical issues concerning the compatibility or incompatibility of love and justice within relationships of love. For example, are loving relations inherently unjust? Might love require justice? Or do love and justice belong to distinct moral domains? The essays in Section II consider the relation between the lovers on the one hand and their broader societal environment on the other. Specifically, how exactly are love and impartiality related? Are they compatible or not? Is it unjust to favor one’s beloved? Finally, Section III looks at the political dimensions of love and justice. How, for instance, do various accounts of love inform how we are to relate to our fellow citizens? If love is taken to play an important role in fostering or hindering the development of personal autonomy, what are the political implications that need to be addressed, and how? In addressing these questions, this book engenders a better understanding both of conceptual and practical issues regarding the relation between love, justice, and autonomy as well as their broader societal and political implications. This paper considers two objections which can be levelled against Leibniz’s account of divine love. The first is that he cannot allow that divine love is gracious because he is committed to the view that love is properly proportioned to the perfection perceived in the beloved; the second is that God is cruel to those who are damned and so cannot be said to love all. I argue that Leibniz has the resources to rebut—or at least blunt—each of these objections.

This paper develops a philosophical account of the relata of romantic love, the nature of the objects in a love-relation. This account holds that the lover who loves and the beloved who is loved are particular people who persist through time by having temporal parts. We show how such a perdurantist account could provide models of different kinds of romantic love: from the love of transitory lovers to the love of immortal beings; from the love of lifelong companions to the (...) love of soulmates. Is it the clever author who offers a guide out of the goodness of his heart? Or more likely, is it the sharp publisher, who knows a good selling point when he or she sees one? One guesses it is the publisher. But as to the present volume, few will complain of the title’s ambiguity, for it entices readers into an compact, well written, and timely argument on political matters of the first importance. Conrad Russell was the author of Academic Freedom, a well regarded and similarly compressed discussion of academic freedom. Academic Freedom preceded the Guide to Liberalism by six years. It was as though Russell had first to taste and see the awful effects of neo-conservatism in his beloved University of  Conrad Russell has a world reputation as an historian of the English Civil War, of the whole seventeenth century, and of the social history of politics before . His several books and hundreds of articles and reviews show that he had an apparently effortless mastery of most world history since the Reformation. I have been unable to deal with Conrad’s historical output in this review, but have discussed it in a forthcoming biographical essay about Conrad Russell in the Bertrand Russell Society Quarterly, “Conrad Russell as Political Intellectual”, forthcoming in . _Russell_ journal (home office): E:CPBRRUSSJOURTYPE2502\REVIEWS.252 : 2006-02-27 11:52 Reviews  London and then, six years later—after due reflection upon the whole horrid mess—to provide a compelling political remedy to the evil apparatus of Mrs. Thatcher and Mr. Major. Academic Freedom, a sister volume to the Guide, dealt with the intellectual and administrative liberty that university teachers must have if their work is to be academically viable and socially valuable. Already in , Academic Freedom offered a sharp attack on the Thatcherite use of league tables and performance indicators, and on high civil servants, vice-chancellors, and government ministers who rely on the numbers. In effect, accountants and managers and long lists of numbers had overtaken much that universities did. Academic Freedom ended with a straightforward prescription: university teachers and (on occasion) responsible administrators should make the hard academic decisions to which they are called—not civil servants, not numbercrunchers, not politicians. This view did not mean elected politicians were released from the burden of honest choice and decision, particularly in regions of governance and public life for which they had direct responsibility and care. But Russell’s point remained: it would be madness if statistical tables replaced responsible and able human beings, or if those human beings accepted that they must become automatic “decision machines”. Conrad Russell died on  October , but must have had a form of prescience. For in , more than thirty academic units and fields were eliminated in United Kingdom universities on grounds of efficiency, ranking in league tables, and performance indication. Each time the administrator concerned threw up her hands, claiming she had no choice, as the league table or the last Research Assessment Exercise “made me do it”. Up the line, politicians have gone further, even rejoicing in the New Management of British higher education and the pleasant prospect of even greater “efficiencies” in the next decade. Conrad Russell well understood that freedom is not just academic. An Intelligent Person’s Guide to Liberalism relies, then, on recent political history to provide its main narrative thrust. By the mid-point of the book, one has the impression that current events have shaped his liberalism, and that his understanding of the history of liberalism is “presentist”. But Conrad Russell starts by saying that he doesn’t pretend to be writing history (or philosophy) in his Guide. To call Conrad Russell “presentist” is to underplay... (shrink)

ABSTRACTAttentional bias to uncertain threat is associated with anxiety disorders. Here we examine the extent to which emotional face distractors and individual differences in intolerance of uncertainty, impact saccades in two versions of the “follow a cross” task. In both versions of the follow the cross task, the probability of receiving an emotional face distractor was 66.7%. To increase perceived uncertainty regarding the location of the face distractors, in one of the tasks additional non-predictive cues were presented before the onset (...) of the face distractors and target. We did not find IU to impact saccades towards non-cued face distractors. However, we found IU, over Trait Anxiety, to impact saccades towards non-predictive cueing of face distractors. Under these conditions, IU individuals’ eyes were pulled towards angry face distractors and away from happy face distractors overall, and the speed of this deviation of the eyes was determined by the combination of the c... I was a doctoral student at IU then and had studied the writings of many of the conference presenters and so the experience of hearing and meeting them in person was a heady one, indeed. I will never forget those impressions of Phil Alperson, (...) Wayne Bowman, Allen Britton, David Elliott, Peter Kivy, Gerard Knieter, Thomas Regelski, Bennett Reimer, John Shepherd, Ann Stokes, Eleanor Stubley, Keith Swanwick, and many others.I was interested in meeting Michael after hearing his response to the presentation of one of my favorite IU professors of musicology, Austin Caswell. Caswell’s provocative paper, “How We Got into Canonicity and What it has Done to Us: An American Music Historian’s View of Music in Academia,” claimed that “the effect of canonicity on American musical life is destructive,” while Michael’s response was characterized by his style of writing that I came to recognize over the decades as distinct, calm, logical, methodical, and based in an extraordinarily wide and deep wealth of historical knowledge. While I greatly admired my rebellious and passionate professor’s views and temperament which were not unlike my own, I also appreciated hearing Michael’s measured and thoughtful response. Thus began my friendship with Michael, who, I learned, was not only a professor [End Page 92] and dean at Towson State University but also an avid big band woodwind doubler who showed interest in my doctoral research in the art of vocal jazz improvisation. That friendship lasted for almost twenty-eight years and we enjoyed memorable reunions at other conferences. For example, there was the ISPME conference held at UCLA where he invited me to dinner with his good friend and connoisseur of fine wines, Bennett Reimer, and the ISPME conference in Helsinki where, after I tripped and severely broke my ankle, requiring surgery, Michael, Estelle Jorgensen, Iris Yob, and two then-doctoral students (Kasia Bugaj and Leonard Tan) visited me in the Helsinki hospital.When I began teaching at the University of Southern California in 1995, it was fortuitous that Michael’s brother, Brian, lived in the Los Angeles area. His frequent visits allowed him to make several guest lectures to my graduate research methods classes, very welcome opportunities. After one of those lectures, I relayed the history of my family’s ballroom in the Chicago area that was open for business with big band music from 1929 until 1967. He asked if I had any artifacts from Madura’s Danceland, and when I mentioned my father’s stacks of dusty record books, newsletters, photos, and posters in our basement, he became very enthusiastic and told me that I had a “gold mine” of an archive with which to write a book about the place! As a trained quantitative researcher, I began to explore the record books to analyze trends in band pay over the Depression and World War II years.1 Over the next ten years, with help from Michael’s regular prodding and encouragement, I organized the large archive into the history of Madura’s Danceland.2 I owe this personally important accomplishment to Michael Mark.Michael invited me (in his endearing way which I could not refuse) to coauthor a music education textbook with him3 and our writing partnership went so smoothly that he invited me to co-author the 4th edition of his Contemporary Music Education.4 Although our writing styles and areas of expertise were very different, I learned much from his narrative approach which included illustrative scenarios, interviews, and the informal use of contractions, a style of writing that was not second nature for me. The #metoo movement has forced many fans to consider what they should do when they learn that a beloved artist has acted immorally. One natural thought is that fans ought to give up the artworks of immoral artists. In Why It's OK to Enjoy the Work of Immoral Artists, Mary Beth Willard argues for a more nuanced view. Enjoying art is part of a well-lived life, so we need good reasons to give it up. And it turns out good reasons (...) are hard to find. Willard show that it's reasonable to believe that most boycotts of artists won't succeed, so most of the time there's no ethical reason to join in. Someone who manages to separate the art from the artist isn't making an ethical mistake by buying and enjoying their art. She then considers the ethical dimensions of canceling artists and so-called "cancel culture," arguing that canceling is ethically risky because it encourages moral grandstanding. Willard concludes by arguing that the popular debate has overlooked the power of art to change our lives for the good. It's of course OK to decide to give up the artwork of immoral artists, but--as Willard shows in this provocative little volume--it's OK to continue to enjoy their art, as well. ABSTRACTBesides physiological, behavioural, and affective effects, romantic love also has cognitive effects. In this study, we tested whether individual differences in infatuation and/or attachment level predict impaired interference control even in the absence of a love booster procedure, and whether individual differences in attachment level predict reduced adaptive cognitive control as measured by conflict adaptation and post-error slowing. Eighty-three young adults who had recently fallen in love completed a Stroop-like task, which yielded reliable indices of interference control and adaptive cognitive (...) control. We did not observe the predicted negative association between infatuation or attachment level and interference control. AO innovated and sculpted an investigative poetic praxis. In a conversation with poet Rachel Levitsky, poetic-voice is viewed not as a precious identifier, but as a means to think through/about form, concluding that form is linked to framing. While poetic-voice may have tendency to precede form, it also erupts as a result of framing techniques. “They are frames that hold the shape of thinking (which is also to say of imagining) [...].”7 This reminds me of my rabbit who symmetrically chewed the corners of his hutch, which makes me wonder if it’s an expression of the shape of some animal anxiety tick I won’t ever have access to. Beyond the form/frame, death is an unoriginal yet unique limit; death is a damn deathless thing. The inhibition of “reading graffiti as rapture, as rupture” is partly due to it being a “look-back” event in that it’s process involves scratching through layers to reveal previous specters underneath. Graffiti (as an ancient genre) has always been a thing of ‘becoming undone’, and therefore ‘belated and always in arrival’ (Levitsky). It’s a Dionysian activity done at night with it’s back turned toward us. "The specter [...] is of the visible, but of the invisible visible, it is the visibility of a body which is not present in flesh and blood [...] appearing for vision, to the brightness of day [...] something becomes almost visible which is visible only insofar as it is not visible in flesh and blood. Suffering On the one hand is the existential problem that leads us to ask on why it exists, and on the other hand is a philosophical and theological question that challenges divine justice or even the existence of God. Hence, religious thinkers have addressed the nature of suffering, kinds, causes and consequences of it. In this paper we will show that sufferings in Rumi’s view are the inverse-horseshoes, He sees the true grace at the exterior wrath, and recognizes true pain (...) at the specious grace. He believes that “fundamental true suffering” is the separation from increate beloved Neglecting which, will result in other kinds that have been nominated “secondary true sufferings” in here; and other life difficulties that are “suffer-liked graces” are nominated “virtual sufferings”, here we will discuss about the results of these sufferings from Rumi’s view. In his viewpoint we’ll see that the faith is the best human reaction to pains and sufferings, with the gifted insight of which, believers will be able to make suffering meaningful and acceptable. According to Rumi, it is just through the awareness of the real suffering that we can pass through the endless path of faith. In this way of curse the worldly sufferings won’t be removed or denied, but will be meaningful and tolerable - or perhaps sweetness - for lover believers. Alberg University of West Georgia To speak of Jean-Jacques Rousseau and scandal is not difficult. Immediately one thinks of his relationship with Mme de Warens, his lover and his beloved mama. Most of his works upset some group or another—other intellectuals (the Discourse on the Sciences andArts), the Genevan authorities (the "Dedication" the Discourse on Inequality), the Church (Emile)—the list could (...) go on and on. In this article I would like to turn away from our usual use ofthe word scandal and look more deeply at the connection between Rousseau's system and the theological or, more properly, the biblical notion of scandal. This notion is obscure. While no one would deny its importance in the New Testament, trying to develop a coherent "theory ofscandal" from the various usages in the New Testament has proven difficult.1 To give only one example of the problem, Christ crucified is proclaimed as a scandal (ICor 1.23) and yet the Christians who follow him are forbidden to cause scandal to others (ICor 8.9), especially the younger and weaker. 1 For a basic understanding ofthe biblical notion ofscandal the following titles are helpful' G. Girard calls this desire "mimetic" or desire that one receives from another. This type of desire leads to scandal. It is here that the connection with Rousseau becomes evident. The famous literary theorist T. Todorov states: "the 'mimetic desire' of Girard is only another name for the amour-propre ofRousseau" (Todorov 38). For his part Girard defines theskandalon (that which causes the scandal) in the following way: It is not an obstacle thatjust happens to be there and merely has to be got out ofthe way; it is the model exerting its special form of temptation, causing attraction to the extent that it is an obstacle and forming an obstacle to the extent that it can attract. (Girard 1987, 416) Rousseau's analysis of amour-propre as that which excites without satisfying, seduces without delivering, and promises without fulfilling, parallels Girard's analysis ofmimetic desire as the doomed-to-be-frustrated reaching for the scanáalon3 Thus, I am arguing that in his various works Rousseau is developing the conceptual possibilities of biblical scandal. While there would be many way's of showing this structural parallel between Rousseau's thought and biblical scandal, I will concentrate on a reading ofthe "Preface" to the Discours sur l'origine et lesfondements de l'inégalité parmi les hommes (1755), in order to show that this work is structured by scandal. It is structured by a human desire that seeks what is unattainable and renders the object unattainable in the very seeking after it. Needless to say, Becca's disappearance totally shatters the lives of Jesse, his beloved partner Alexandra, and their two boys, Matt and Josh.On the verge of a complete mental breakdown, and desperate to manage the anxiety, uncertainty, terror, and encroaching despair, Jesse begins to engage in a severe form of meditation, deliberately dwelling on images of what Becca might be enduring, however gruesome and devastating. He pictures her dead in the woods, sold to the highest bidder, imprisoned in an attic, abused physically and sexually, buried alive in a crate desperately praying to be rescued, treating each possible future "as a shard-like perspective on a fear-inducing, darkly humming [End Page 20] crystalline monstrosity." For Jesse, this visualization practice is an act of solidarity, not masochism, a way to love his precious little girl as she really is, no matter what she went through or is still going through. Anything less feels like a betrayal, like a "spineless retreat from the reality of Becca's life." Facing the brutal truth about Becca also becomes an integral part of his piety, his worship. As the saga unfolds, Jesse embarks on a weird but wild spiritual quest, a quest to see and surrender to the world in all its wonder and ambiguity, grace and threat, the world that gave him the greatest gift imaginable, Becca, a "beautiful, perfect little being," only to take her away and hand her over to a fate worse than death.4Later in the story, Jesse and Alexandra become foster parents to an abduction survivor named Maddy. Their worst nightmares about what probably happened to Becca actually did happen to Maddy. Stolen from her family at a young age and chained up in a cold, lonely basement, Maddy was subjected to years of torture, malnourishment, deprivation, disease, and rape, forced to bear the children of her captors. Shortly after Maddy and her kids move in, Jesse schedules a meeting with Father Jimmy, "his favorite delusional priest." Jesse admires and appreciates Father Jimmy's intelligence, lovingkindness, and nonjudgmental nature. But he is not bashful about challenging his "supernatural mumbo-jumbo."5 On this particular occasion, they gather to talk about the theological implications of Maddy's horrific life and whatever unthinkable horrors befell Becca. The conversation gets quite heated. Growing increasingly irate, Jesse asks Father Jimmy if he prays for Maddy, Becca, and other missing children and trusts in a God who permits their dreadful circumstances and could do something to ameliorate them. Father Jimmy nods in the affirmative and gently asks a question of his own: "Why would you be angry at a God you don't believe in?" Jesse thunders back:I'm not angry at your fictional God! … I'm angry at you. You worship and pray to a being who allowed Becca and Maddy to be raped and tortured, and in Becca's case probably murdered. In one installment the narrator tells of meeting a Yankee, who had just come from Florence the beautiful. Our friend approached (...) him warily, and began to ask him what he had seen, what admired. Then, after a little circumlocution, he dashed at once, in medias res, by saying, "Of course, you were in raptures with the Venus de Medici?"--expecting an answer such as he would himself have given. "Well, sir, to tell you the truth, I don't care much about those stone gals," was the answer he received. Our friend collapsed. Had anyone in his presence denied the orthodoxy of St. Augustine, or abjured the Thirty-Nine Articles, there would have been more sorrow in his anger, but scarcely more indignation. The Venus de Medici--a classic chef d'oeuvre--a thing which Praxiteles might have touched with his chisel, or Pericles have looked upon, to be called a "stone gal"! Had he doubted its genuineness, or spoken of it as a specimen of secondary art, he might have been deemed critical, hypercritical; but this was a classic impiety, an irreverence, a profanity. As if that were not enough, the Yankee's words betrayed "uncivism" and "egoism." The unflappable Yankee who is irremediably unaware and proud of it and the overly fastidious, overly aestheticized Englishman were both destined to become stock characters in novels depicting Americans abroad, and here we see an early confrontation [End Page 203] between their rival sensibilities. Even though the Venus de Medici has now completely vanished from the modern imaginary museum of masterpieces, it was once among the most beloved, celebrated, and reproduced statues of antiquity; its repute was far beyond that of the Mona Lisa today, and from the time it was unearthed at the end of sixteenth century through the nineteenth century it was the indisputable exemplar of beauty. So it is no surprise that the Englishman, who, like all cultivated people of his day, was well versed in the world of classical antiquity, was mortified by the American's obliviousness before this "classic chef d'oeuvre"; for it revealed a man so utterly lacking in taste and sensibility that he did not have the wherewithal to know that he had been "irreverent" when he called the Venus de Medici "a stone gal."Where this anecdote moves into less familiar territory, however, is the Englishman's characterization of the Yankee's taste as uncivic and egoistic, as provincial and narrow. His willingness to judge a total stranger, to hold him accountable to a single standard of judgment, could not be in sharper contrast to our contemporary attitudes. Today subjectivity is celebrated in the common saying that everyone is entitled to his or her opinion and taste; what is more, diversity of tastes is regarded as a measure of personal freedom and democracy. One of the issues with introducing animal rights law is whether the problem is quantitative or qualitative, whether it can be achieved by working within existing legal paradigms or whether it requires a new set of paradigms. The answer is fundamental: a quantitative problem can be solved by applying more of the same solutions, while a qualitative problem requires completely different solutions. The qualitative camp can be represented by, say, Professor Gary Francione, demanding not only rights for animals but that (...) they have personhood and are no longer considered “property.” The quantitative approach can be finely represented by Professor David Favre, who has argued for many years that we can make progress by developing existing legal principles to give some rights to some animals, and he does so eloquently in his new book. He is clear in his view that progress is, and can continue to be, made with a series of steps, as he puts it, “climbing the slippery slope toward personhood” (p. viii).His case is supported by looking backward—progress made in establishing the rules governing humans in their relationships with animals—as well as forward to developments that will support continuing improvement in the lives of animals, not least the potential for technology (for example, through cell- and plant-based meat). At the same time, he also rightly rejects the concepts of animal welfare and animal rights being at odds, let alone either of them being a panacea for better lives for animals.One aspect of animal law that Favre believes does need to change is that of property status. As he says, the status of animals as personal property is “critical to the future of animal law” (p. 25). In general, the solutions have been largely binary—that animals simply cannot be property for them to have meaningful rights or that animals can be property and still have rights. The former makes intuitive good sense (and is consistent with the objectives of the human abolitionist movements) but would have enormous effects on economic activity throughout the world. The latter is appealing because it does not change the current paradigm, so can be developed more easily.Favre's premise is that we are moving toward rights for animals, so we need to find a way of integrating animals into the current legal system rather than having to destroy and reconstruct the legal system. His ingenious solution is to propose a fourth category of property, alongside real, personal, and intellectual property: “living property.”Within this category, he envisages using the common law concept of the trust to provide equitable “self-ownership,” where an animal has equitable “ownership” while a human retains legal “ownership.” He then connects this concept to adaptations in other aspects of law that start to recognize the selfhood of animals, creating a platform onto which broader and deeper rights for animals can develop, such as the status of “animalhood” (p. 72) and the corresponding legal right of consideration before decisions are made by the state affecting an animal's fundamental interests (such as continuing to be alive). By putting animals in a separate class—rather than uncomfortably leaving them in personal property—he creates a possible route for animal rights that seems less paradigm-busting than removing them from being property altogether.Drawing on evidence from criminal law, tort law, equity (trusts), property law, and family law, he shows how in many places—with a focus on states in the United States—existing laws are being adapted (“green shoots” p. 81) to recognize that animals are more than personal property, in ways that cannot be explained simply through the growth of regulations. For example, family law is starting to recognize that in the division of matrimonial assets, companion animals cannot be treated simply like any other personal property such as a table or a car based on who paid for them. Because animals are “living property,” the courts should take account of other aspects, such as who cared for the animals and who looked after them. Similarly, the concept of extending trust law so that an animal can be the beneficiary of a trust—in the same way as a human can be but inanimate personal property cannot—shows that the law can understand that companion animals can play a large emotional role in our lives (as well as we in theirs), such that we want to ensure proper care for them after we die.The book raises important issues. First, it is intentionally about domestic animals, with their close links with humans, so the potential for laws to engage is much easier than with, say, farmed animals. The danger with solutions that focus on domestic or charismatic animals (e.g., dogs, chimpanzees, elephants) is that the arguments may be pertinent essentially only to those species and therefore hard to apply to animals of less charismatic species, say in a factory farm (but who are present in much greater numbers and generally badly treated in comparison). He “leaves for another day” (p. 32) the discussion about other animals. Hopefully that day will come, as it would be interesting to see how Favre could extend his concept to animals for whom the public has less affection and less appreciation of their capacities (and for whom the prospect of death is much more real and imminent).Secondly, public support for these ideas about living property may simply not be present. If there is not a sufficient groundswell of support for changing the status of animals, then whether one proposes changing it to not-property or “self-owned” property doesn't matter (if someone doesn't like needles, it doesn't matter whether the needle you propose to use is big or small). This may be too pessimistic, of course (people can be helped to overcome a fear of needles, and one way to start is with small needles). Perhaps the law should start with small changes to recognize at least a few animals—their sentience, their capacities for pleasure and pain, their emotions and preferences, their potential for autonomy—and build public support from there.There is also the underlying and more radical point about whether these ideas—the trust for a beloved companion set up by the human, the divorce settlement that doesn't just give the companion to the party who paid for them—are actually bringing about changes for animals as such or are simply adapting laws to help humans, recognizing human needs, and do not actually change the status of animals. The ends are still humans, and the means are still animals.This is not intended to paint a bleak picture: The more bluntand uncompromising part of the animal rights movement that has been focused on the qualitative problem has hardly been successful at getting animal rights laws passed anywhere in the world, so everything that moves us closer to a better, richer, more thoughtful view of animals will help. Favre's approach has ingenuity, shows good sense, and has the potential to bring about real animal rights. The themes and cases in this book that show how courts and legislatures are becoming more aware of the sentience of at least some animals, as well as proposing a middle path in the debate about animals as property, are important in the journey toward recognition of animal rights.
